These terms govern the online rental and purchase of films on https://smolderscarabee.be. They apply to every order, to the exclusion of any other terms. Placing an order means accepting them.
Physical goods — books, DVDs — sold through the site's shop are governed by separate terms, shown at the time of ordering.
Each film is offered in two forms, sometimes only one:
Gives access to the film for 48 hours. The countdown does not start at payment but the first time you start the film: buying without having time to watch does not consume the rental. After that period, the link stops working.
Gives unlimited access, for as long as the film remains offered on this site. This is not a download: the film stays available online, through the link you receive.
Prices are shown in euros, all taxes included, on each film's page. The amount charged is the one displayed when you order. Nothing is added: there is nothing to ship.
They include Belgian value added tax at the standard rate of 21%, which applies to electronically supplied services. The amount excluding VAT and the VAT itself are shown on the confirmation page and in the email sent to you; that summary serves as your receipt.
You order from the film's page. Payment is handled by Stripe Payments Europe, Ltd. We never see or store card details: they go straight to Stripe, on its own pages.
Giving an email address is optional. It is used only to send you your link, which lets you find it again after closing the tab. Without it, the link is shown on screen after payment and cannot be recovered afterwards: keep it.
The sale is concluded when Stripe confirms payment. The contract is archived as the record of your access, and remains available on request at the address above.
Access is immediate. It takes the form of a personal link, sent by email if you gave one, and shown on the confirmation page in every case.
The link is strictly personal. Sharing it amounts to giving the film away, and entitles us to disable it.
Digital content supplied immediately falls outside the fourteen-day right of withdrawal, provided the buyer has given prior express consent and acknowledged losing that right — article VI.53, 13° of the Belgian Code of Economic Law. That is what you confirm by ticking the box before payment.
Since access is delivered as soon as you pay, the service is performed immediately: no withdrawal is possible afterwards.
That does not leave you without recourse. If the film will not start, breaks up, or proves unusable for a reason on our side, write to us: we refund or extend the access, whichever you prefer.
Any other refund request will be considered, without our being able to commit to it in advance. Write to lescarabeeasbl@gmail.com, giving the email address you ordered with, or your link. We answer within seven working days. An accepted refund is made by the same means of payment, within fourteen days.
A recent browser able to play HTML5 video — which all common browsers do — and a connection good enough for a video stream. There is no software to install and no account to create.
Available subtitle languages are listed on each film's page. They differ from film to film, and some films have none.
We do everything we can to keep the films available, without being able to guarantee uninterrupted service: a failure, maintenance, or a problem at our host may interrupt access. Should that happen, we extend the rental by at least the length of the interruption, or refund it.
Our liability is limited to the amount paid for the access concerned. That limit does not apply in cases of fraud, gross negligence, or personal injury.
The films, their images and their texts are protected. Both rental and purchase grant a right of private viewing that is personal and non-transferable.
Recording, copying, rebroadcasting, making available and public screening are prohibited, by any means whatsoever. A public or classroom screening requires separate permission, which we grant readily: write to us.
The details are in our privacy policy. In short: we keep your email address if you give one, the language you ordered in, the amount, and the dates attached to your access. We keep no banking data and sell nothing on.
Belgian law applies. If you are a consumer, you keep the benefit of the mandatory provisions of your country of residence.
In case of disagreement, write to us first: most situations are settled that way. Failing that, you may refer the matter free of charge to the Belgian Consumer Mediation Service, Boulevard du Roi Albert II 8 box 1, 1000 Brussels (mediationconsommateur.be). The courts of the Liège district have jurisdiction, without prejudice to the rules protecting consumers.
